The Treasury Department and IRS released proposed rules for the Education Freedom Tax Credit, a national scholarship program launching January 1, 2027. Scholarships could pay for private school tuition and for public school expenses including tutoring and services for students with disabilities.
The National Center for Learning Disabilities and 15 other civil rights groups urged governors to opt out, noting that students with disabilities who transfer to private schools give up their right to a free appropriate public education under IDEA. Families considering a scholarship should understand which IDEA protections would and would not follow their child. Public comments on the proposed rule will be accepted for 60 days.
